PRIVACY POLICY

HiClub Inc. (“HiClub,” “we,” “our,” or “us”) is committed to protecting your privacy. This Privacy Policy explains how your personal information is collected, used, and disclosed by HiClub. This Privacy Policy applies to our Go Translate mobile apps for iPhone or Android mobile devices (collectively, our “Service”). By accessing or using our Service, you signify that you have read, understood, and agreed to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy and our Terms of Service . Quick Facts:

  1. The content you upload and other information we collect may be stored and processed in the United States or any other country in which HiClub or its affiliates or service providers maintain facilities and will be subject to the laws of those jurisdictions, which may provide different protections than where you reside.
  2. We use your location to deliver the Service and for advertising and marketing. See Section 1 for more information.
  3. We apply algorithms to the content you upload to understand the users of our services better and for marketing and interest-based advertising.
  4. We share information with third parties in our corporate group as well as with service providers. In limited situations law enforcement and other third parties may have legal rights to access your personal information including the content you upload, including any sensitive information. See Section 3 for more information.

1. WHAT INFORMATION DO WE COLLECT AND FOR WHAT PURPOSE?

The categories of information we collect can include:

  1. Information you provide to us directly. We may collect personal information, such as your name, phone number, location, email address, and password when you register for our Service, sign up for our mailing list, or otherwise communicate with us. We may also collect any communications between you and HiClub and any other information you provide to HiClub, including any comments and opinions you provide when responding to surveys or taking part in promotions we run. The primary purposes for which we collect this information is to provide the service to you, address your queries, issues and concerns, improve our products and services, and provide you with notifications and marketing communications. We may also use this information for the other purposes described in Section 2.
  2. Text, photos, voice, and other content you provide for translation and through your use of the Service. We collect information about how you use the Service, your actions on the Service, and content you post to the Service, including text, photos, and voice (via your device’s microphone) you provide to the Service for the translation functionality (collectively, “User Content”). When you use the voice content translation functionality of the Service, we will convert the recording into text using the applicable functionality of the Service. To share photos, we will access your device camera roll, camera, microphone with your permission. If you need to update your permissions, you can do so in the “Settings” app of your device. The primary purposes for which we collect your User Content is to provide you with the Service and to test and improve the Service. We may also use this information for the other purposes described in Section 2. Please remember that HiClub may, but has no obligation to, monitor, record, and store User Content in order to protect your safety or the safety of other users, to assist with regulatory or law enforcement efforts, or to protect and defend our rights and property. By using the Service, you consent to the recording, storage, and disclosure of such communications you send or receive for these purposes.
  3. Translation results. If you use the translator functionality on the Service, we will collect the translated text results. We may use the translation results as set forth in Section 2 below, such as for analyzing user preferences, enhancing the Service and support, and to conduct more accurate marketing.
  4. Location information. We collect information about your location through GPS, Wi-Fi, wireless network triangulation, or other methods in order to obtain your location for the purposes of providing our Service. We may also approximate your location by your IP Address. The primary purpose for which we collect your location is so that we can suggest the appropriate local language into which your User Content may be translated through the Service. We may also use this information for the other purposes described in Section 2. We maintain location information only so long as is reasonable to provide the Service, and then we delete location data tied to your personal information. We may maintain de-identified location data for a longer period of time in order to analyze aggregate trends and metrics.
  5. Information we receive from third parties. From time to time, we may receive information about you from third parties and collect information about you that is publicly available.
  6. Usage and device information collected automatically through tracking technologies. To provide a personalized and high-quality experience for our users, we, and our third-party partners, may use various technologies that automatically record certain technical information from your browser or device when you visit our website, read our e-mails, use our Service, or otherwise engage with us. This information is typically collected through a variety of tracking technologies, including cookies, web beacons, embedded scripts, location-identifying technologies, file information, and similar technology (collectively, “Tracking Technologies”).
    We, and our third-party partners, use these Tracking Technologies to automatically collect usage and device information, such as:
    1. Your IP address, browser type, Internet service provider, platform type, device type, operating system, date and time stamp, a unique ID that allows us to uniquely identify your browser, mobile device or your account, and other such information.
    2. We also collect information about the way you use our Services, for example, the site from which you came and the site to which you are going when you leave our website, the pages you visit, the links you click, how frequently you access the Services, whether you open e-mails or click the links contained in e-mails, whether you access the Services from multiple devices, and other actions you take on the Services.
    3. When you access our Services from a mobile device, we may collect unique identification numbers associated with your device or our mobile application (including, for example, a UDID, Unique ID for Advertisers (“IDFA”), Google AdID, or Windows Advertising ID), mobile carrier, device type, model and manufacturer, mobile device operating system brand and model, phone number and, depending on your mobile device settings, your geographical location data, including GPS coordinates (e.g., latitude and/or longitude) or similar information regarding the location of your mobile device, or we may be able to approximate a device’s location by analyzing other information, like an IP address.

    We may collect analytics data, or use third-party analytics tools such as Google Analytics, to help us measure traffic and usage trends for the Services and to understand more about our users by monitoring aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns on our website.     We may also work with third-party partners to employ technologies, including the application of statistical modeling tools, which permit us to recognize and contact you across multiple devices.

    Do Not Track Signals. Although we do our best to honor the privacy preferences of our users, we are unable to respond to Do Not Track signals set by your browser at this time.

    If you would prefer not to accept cookies, most browsers will allow you to (i) change your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; (ii) disable existing cookies; or (iii) set your browser to automatically reject cookies.

    Please note that not accepting cookies may negatively impact your experience using the Service, as some features and services on our Service may not work properly. Depending on your mobile device and operating system, you may not be able to delete or block all cookies and you may not be able to block non-cookie technologies and these browser settings that block cookies may have no effect on such techniques. You may also set your e-mail options to prevent the automatic downloading of images that may contain technologies that would allow us to know whether you have accessed our e-mail and performed certain functions with it.

    We and our third-party partners may also use cookies and tracking technologies for advertising purposes. For more information about tracking technologies, please see “Third-Party Tracking and Online Advertising” below.

2. HOW DO WE USE YOUR INFORMATION?

We use the personal information we collect for purposes described in this Privacy Policy or as otherwise disclosed to you on our Services or in connection with our Services. For example, we use your information:

  1. To fulfill your requests and provide our Service to you. For example, we use your information to fulfill your requests on the Service, provide the text, photo, and voice translation functionality as part of the Service, and respond to your customer service requests or feedback. We may also use your information to personalize your experience with us.
  2. For marketing purposes. We may send you communications about new features, updates, products, and special offers. We might also use your information to serve you ads about products and special offers about our products or other products we think you might find interesting. We also use individual and aggregate information about you and others to inform our marketing and advertising campaigns.   3. To communicate with you. For example, if you register with us, we may enroll you in our e-mail newsletter or other periodic electronic communications. We may send you user surveys and promotional communications. We may communicate with you by e-mail, phone, mail, or other means.   4. To monitor, improve, and develop our Service. We may use your information and User Content to understand our users and customize and tailor our services and product offerings. We analyze statistics and trends to make our websites and Service better and to develop new services, products, or features. We may use your information and any information that we collect about you, including User Content and translations, internally to train our AI/machine learning algorithms to analyze and improve our Service.
  5. To protect the security and integrity of our business and comply with legal requirements and obligations, or as otherwise permitted by law. We may use information to protect our company, our users, and our websites. We may also use information in order to comply with laws, regulations, court orders, or other legal obligations or to assist in an investigation, to protect and defend our rights and property, or the rights or safety of third parties, to enforce our Terms of Service , this Privacy Policy, or agreements with third parties, to detect and prevent fraud, or for crime-prevention purposes.

3. SHARING OF YOUR INFORMATION

We may share your personal information in the instances described below. For further information on your choices regarding your information, see the “Control Over Your Information” section below.

We may share your personal information with:

  1. Third parties at your request. For example, you may have the option to share your activities on the Service with your friends through email, text, or on various social media sites;
  2. Other companies and brands owned or controlled by HiClub and other companies owned by or under common ownership as HiClub, which also includes our subsidiaries (i.e., any organization we own or control) or our ultimate holding company (i.e., any organization that owns or controls us) and any subsidiaries it owns. These companies will use your personal information in the same way as we can under this Privacy Policy;
  3. Third-party vendors and other service providers that perform services on our behalf, as needed to carry out their work for us, which may include identifying and serving targeted advertisements, providing mailing services, providing tax and accounting services, web hosting, or providing analytic services;
  4. Third parties with whom we partner to provide contests and sweepstakes, which will usually be identified by name in the Official Rules of the contest or sweepstakes;
  5. The public when you provide feedback on our Service. For example, if you post User Content on our blog or comment on our social media sites, your information, such as your first name, last initial, state of residence, and comments, may be displayed on our Service or on our social media pages;
  6. Other parties in connection with a company transaction, such as a merger, sale of company assets or shares, reorganization, financing, change of control, or acquisition of all or a portion of our business by another company or third party, or in the event of a bankruptcy or related or similar proceedings; and
  7. Third parties as required by law or subpoena or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our Terms of Service or to protect the security or integrity of our Service; and/or (c) to exercise or protect the rights, property, or personal safety of HiClub, our visitors, or others.

We may also share information with others in an aggregated or otherwise anonymized form that does not reasonably identify you directly as an individual.

4. CONTROL OVER YOUR INFORMATION

Profile and data sharing settings. You may update your profile information, such as your user name and contact information, and may change some of your data sharing preferences on your Settings page or by emailing us at GTfeedback@creativeappnow.com.

Access to your device information. You may control the Service’s access to your device information through your “Settings” app on your device. For instance, you can withdraw permission for the Service to access your location, camera, camera roll, and microphone.

How to control your communications preferences. You can stop receiving promotional email communications from us by clicking on the “unsubscribe” link provided in such communications. We make every effort to promptly process all unsubscribe requests. You may not opt out of service-related communications (e.g., account verification, transactional communications, changes/updates to features of the Service, or technical and security notices).

Modifying or deleting your information. If you have any questions about reviewing, modifying, or deleting your information, or if you want to remove your name or comments from our Service or publicly displayed content, you can contact us directly at GTfeedback@creativeappnow.com. We may not be able to modify or delete your information in all circumstances.

5. THIRD-PARTY TRACKING AND ONLINE ADVERTISING

We participate in interest-based advertising and use third-party advertising companies to serve you targeted advertisements based on your online browsing history and your interests. We permit third-party online advertising networks, social media companies, and other third-party services to collect information about your use of our Service over time so that they may play or display ads on our Service, on other websites, apps, or services you may use, and on other devices you may use. Typically, though not always, the information used for interest-based advertising is collected through cookies or similar tracking technologies. We may share a common account identifier (such as an e-mail address or user ID) or hashed data with our third-party advertising partners to help identify you across devices. We and our third-party partners use this information to make the advertisements you see online more relevant to your interests, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research.

You may also be able to set your browser to delete or notify you of cookies by actively managing the settings on your browser or mobile device. Please note that some advertising opt-outs may not be effective unless your browser is set to accept cookies. Furthermore, if you use a different device, change browsers, or delete the opt-out cookies, you may need to perform the opt-out task again.

You may also be able to limit certain interest-based mobile advertising through the settings on your mobile device by selecting “limit ad tracking” (iOS) or “opt out of interest based ads” (Android).

Google Analytics and Advertising. We use Google Analytics to recognize you and link the devices you use when you visit our site or Service on your browser or mobile device, log in to your account on our Service, or otherwise engage with us. We share a unique identifier, like a user ID or hashed e-mail address, with Google to facilitate the service. Google Analytics allows us to better understand how our users interact with our Service and to tailor our advertisements and content to you. These features enable us to use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick advertising cookie) or other third-party cookies together to inform, optimize, and display ads based on your past visits to the Service. You may control your advertising preferences or opt out of certain Google advertising products by visiting the Google Ads Preferences Manager, currently available at https://google.com/ads/preferences, or by visiting NAI’s online resources at http://www.networkadvertising.org/choices.

6. HOW WE STORE AND PROTECT YOUR INFORMATION

Data storage and transfer: Your information collected through our website may be stored and processed in the United States or any other country in which HiClub or its affiliates or service providers maintain facilities. If you are located in the European Union, Canada, or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to the U.S. or any other country in which HiClub or its parent, subsidiaries, affiliates, or service providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy. Data retention: We will retain your personal information only for as long as reasonably necessary to maintain the Service, to meet legal and accounting obligations, and for the purposes described in this Privacy Policy. We may anonymize and/or aggregate personal information and store it in order to analyze aggregate metrics and trends.

Keeping your information safe: We care about the security of your information and employ physical, administrative, and technological safeguards designed to preserve the integrity and security of all information collected through our Service. However, no security system is impenetrable, and we cannot guarantee the security of our systems 100%. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and, where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

7. CHILDREN’S PRIVACY

HiClub does not knowingly collect or solicit any information from anyone younger than the age of 13 on this Service. In the event that we learn that we have inadvertently collected personal information from a child younger than age 13, we will delete that information as quickly as possible. 8. LINKS TO OTHER WEB SITES AND SERVICES

The Service may contain links to and from third-party websites of our business partners, advertisers, and social media sites and our users may post links to third-party websites. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for their policies. We strongly recommend that you read their privacy policies and terms and conditions of use to understand how they collect, use, and share information. We are not responsible for the privacy practices or the content on the websites of third-party sites.

10. CHANGES TO OUR PRIVACY POLICY

We may modify or update this Privacy Policy from time to time to reflect the changes in our business and practices, so you should review this page periodically. When we change the policy in a material manner, we will let you know and update the ‘last modified’ date at the bottom of this page. If you object to any changes, you may close your account. Continuing to use our Service after we publish changes to this Privacy Policy means that you are consenting to the changes.

11. SPECIAL INFORMATION FOR CANADIANS

The information in this section applies to users of the Service in Canada and supplements the other provisions of this Privacy Policy with additional information for Canadians.

The Service uses algorithms to recognize patterns in the User Content (see Section 1) that you send to us for translation. We may use those patterns, along with the other information we collect about you, to understand the users of our Service better and to serve you ads about products and special offers about our products or other products we think you might find interesting. Your User Content (including any sensitive User Content) and the data we derive from it could become available to third parties who have the ability to access it, such as third parties (including law enforcement or persons who you are engaged in a dispute with) that have a subpoena, warrant, court order, or other legal basis to require us to provide them with the information.

You have certain rights under Canadian law with respect to your personal information that we hold:

  1. Right of access. You have the right to obtain (i) confirmation of whether, and where, we are processing your personal information, (ii) a copy of the personal information we hold about you, and (iii) information about the categories of recipients with whom we may share your personal information.
  2. Right to withdraw consent. You have the right to withdraw consent for secondary uses of your personal information (such as marketing) that are not required for us to provide you with the Service, manage our business, and/or comply with laws, and to delete personal information we no longer need to fulfill the purposes for which it was collected.
  3. Right to correction. You have the right to request that we correct any inaccurate or incomplete personal information we hold about you.
